The ninth circuit court of appeals ruled on Tuesday that it would reexamine the legal dispute concerning the executive power with an larger panel of 11 judges. The judicial body also overturned a earlier decision from a three-judge panel that had supported the federal government.

Legal Saga Over Troop Deployment

This order represents the latest development in a protracted legal battle over whether the administration has the authority and justification to deploy national guard forces in the city. Approximately two hundred troops have been in limbo since late September when the deployment effort was started in response to ongoing demonstrations.

Differing Viewpoints

The federal government has claimed that government employees at the immigration center in south Portland were under attack, while city and state officials assert that local officers have command of the situation.

Contrary to descriptions of the city as a conflict zone, residents have been sharing footage of scenic paths and a vibrant culinary culture, and organizing events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Court Proceedings

The appeals court decision came after a US district judge in the city issued two temporary restraining orders this period – one preventing the federal control of the state troops, and another prohibiting the use of any national guard troops in Oregon, after attempts to circumvent the initial injunction by mobilizing out-of-state forces.

On the previous day, the appeals court had temporarily suspended the initial decision – allowing control of 200 Oregon national guard – but the subsequent injunction remained in place, preventing the actual deployment of the forces.

Full Panel Consideration

The Tuesday decision means the matter will be heard “en banc” – with all decisions under consideration together – by a group of 11 judges.

“This ruling shows that facts are important and that the judicial system are striving to ensure government responsibility. The founding document limits the president’s power, and local populations cannot be treated as a training ground for unchecked federal authority,” stated the state attorney general in a statement.

“The judicial body is sending a definite signal: the president cannot send the armed forces into US cities without cause. We will continue defending Oregon’s laws, values, and sovereignty as this legal proceeding moves forward and our legal battle continues in the judicial system.”
